BDSM filmmaker fights charges

Anyone familiar with Barry Goldman and the Feds' case against him for running "Torture Portal"? Apparently the FBI set him up for arrest for two years. Glad to know the Feds think BDSM movies are so grievous a threat to America's safety that they dedicated their resources to fighting the war against consensual spanking and bondage. WTF? Now, Goldman's lawyers are saying that the government is trying to manipulate the outcome by moving the trial to Montana. MONTANA. Goldman is from Joisey. I don't think Joisey will play too well in MONTANA. Jeez.

Goldman’s attorneys said that despite the fact that the movies were allegedly mailed from New Jersey and only from New Jersey and despite the fact that Goldman lived in New Jersey during the entire period covered in the indictment, the government wanted to keep from the jury that it initially opted for a Montana jury to apply its community standards.

“The government’s attempt to avoid New Jersey despite the many and obvious links to New Jersey is telling,” the defense’s motion on evidence said. “It strongly suggests that the government did not believe that these movies violated New Jersey community standards.

Goldman’s Attorneys Want Obscenity Charges Dropped

The defense goes on to claim that prosecutors went "forum shopping" to find a conservative jury who would find against their client. What's really grim are the pennalties Goldman faces for his BDSM biz.

If convicted, Goldman faces a maximum penalty of five years in prison and a fine of $250,000 on each of the eight counts charged in the indictment.

The Justice Department also is seeking forfeitures of all copies of the movies, as well as proceeds from the sale of the movies. In addition, they are seeking the forfeitures of domain names MastersOfPain.com and TorturePortal.com, as well as an email address, SirBNY@aol.com.

Forfeiture of email? What? Is this now a common prosecutorial request when trying to shut down an Internet porn person or is it something new and ugly directed at Goldman?

Bondage fans: try my trick

Readers frequently ask me where I find the cool images I publish here. One of my best sources is eBay, where the wildly diverse vendors sell wildly diverse merchandise. I like to joke that our home is "the house that eBay built," because much of the art, books, most of the clothing and jewelry, and even some of our furniture came from eBay. Living in a rural district of Georgia partly explains it: choices at local stores are limited. How else could I find an original Thai folk painting, a sacred goat head from Tibet, designer clothes,and bookcases for my office, all at ridiculously low prices?

eBay is my first choice for locating unique images on erotic themes as well. The difference between most of what I get on eBay and what I find through more traditional searches (of websites and google images) is that many items are rare or one-of-a-kind. Someone finds a bunch of sexy old postcards buried in their dead uncle's attic; someone inherits a statue with an obscene theme; someone else who usually specializes in car parts suddenly gets a stack of funky old sexploitation movie posters. What to do with such things? Sell 'em on eBay, of course. Oddly, what I especially love is that stuff on eBay is so ephemeral. Often, you have only ONE chance in your life to see a particular picture before it's sold and vanishes into another individual's private collection.

Since I can't spend every waking minute ferreting out the happy perversion on eBay, I do the next best thing: I set up eBay searches that send me clips of new and interesting items via email. If you are a serious bondage fan, who can't get enough rare images of vintage bondage, I'd like to recommend you try using one of these searches. I hope the below is all the reason you need.

How to do it:

NOTE: You must be registered with eBay so you can verify that you are old enough to legally look at this stuff in their well-hidden adult section.

Go to Everything Else. Click the Adult category. Ebay will ask you to sign in, and then will ask you to agree that you're over 18 and want to look at their naughty stuff. You'll have to click one more time to continue to the adult area, and then you're in.

Type "bondage" (or term of your choice) into the search box. When the results pop up, you'll see something like this at the top of the items

Hit "save this search" and you will be able to specify how long you want eBay to keep sending you the emails.

That's it. By the next day you'll be getting emails with thumbnails of new listings in eBay's R to X-rated, adult category.

Vanity Fair tries (and fails) to parse the meaning of Internet crime

A new investigative piece from Vanity Fair takes a detailed look at the people, events and politics of the Craigslist murder that made headlines this summer. It starts off well, acknowledging that this murder (like all murders) is "a very human mystery":

The “Craigslist Murder” was a crime made possible by the Internet, and the prime suspect was apprehended through online sleuthing. But the killing of Julissa Brisman allegedly by Boston University medical student Philip Markoff is still a very human mystery, with dark sexual overtones and surprising contradictions.

But that point -- that the Internet is only one of many ways in which criminals find victims -- is then lost in the details of the crime and its many players.  In the end, the reporter and her interviewees all seem to suggest that the Internet is a dangerous place because we don't have cops around to police us. Pardon me, but in the real world, where we do have cops to police us, people still commit murders, all the time, for all kinds of sick and sad reasons. Before you police the Internet shouldn't you police every bar and club in the US, which is where most murderers find their victims? Wait: how about policing every home too, since most murders and violent crimes are not committed by strangers but by the people you know best and often live with?  Or as cops like to say when questioning suspects, "before you look at the outlaws, look at the in-laws."

I'll recommend this article to anyone who is interested in true crime stories or has a special interest in this case, and would like to know more about the people involved and the impact it has had on their loved ones, but if you're looking for a rational voice to put the Internet in perspective as a social phenomenon, rather than a pit of vipers where anyone may be a victim at any time, you'll need to keep looking.

This paragraph, however, is of vital interest to everyone, if only to remind us that "Internet" and "privacy" don't belong in the same sentence. Assumptions about privacy you make in real life cannot be superimposed onto the Internet. The Internet is not 3-D and 3-D is not the Internet: confuse the two at your own peril. This paragraph pretty much nails the lesson every Net user needs.

Few Americans, even those from the younger, Internet generation, seem to understand how easily their clicks and text messages can be detected, and how little privacy any of us have anymore. Every search, every posting, every text message or Twitter, leaves a cyber footprint. The content of every e-mail sent by any one of us is kept by the Internet service provider and stored for a period of time, usually six to nine months. Google and Gmail used to store e-mails indefinitely; now they claim they’re within the same range, but all the e-mail we choose to keep until we delete it can also be accessed by the provider. “If you can see them, they can see them,” says Rasch.

From Gawker, a brief analysis of why a (once) hot new porn site grew cold quickly. Bottom line: not enough extreme sex. It's an affliction that's hurting the professional porn industry as well. The Internet's nutty salad of hardcore, far-fetched, XXX-treme delights has dulled porn buyers' appetite for more mainstream sex, and created a thirst for stuff that's stranger and wilder than anything they've seen before. Sites that aim at tasteful may draw an audience of classier people but anyone who's spent an hour on the Internet knows classy people are, how shall I tastefully phrase it...a vanishingly small market niche. Loud, crude, and shocking goes viral; classy can't compete, at least not in terms of audience size. Charging people for stuff they can find in abundance elsewhere was not the smartest business model either.

How Crowdsourced Porn Failed

Zivity clung to artistic pretensions, screening pictures for "tastefulness," "respect," and "promoting female beauty." Which is morally commendable, but proved disastrous from a business perspective; free tasteful nude pictures are chock a block on the internet; as even Arianna Huffington knows, people only pay for the fetish stuff.

I question why anyone would install it at all unless it is their purpose in life to be a flaming A*hole.  I also wonder how the people "caught" will react.  In addition to the huge embarrassment factor, this brings Internet privacy invasion to a new low. Bad enough the government and our ISPs can tap into this information: do you want your friends or relatives to know exactly where you go for late-night jollies?  Methinks people are increasingly mistaking real life for a reality show.  I can't wait to see the first legal test of this site after someone's life is ruined by having his or her most secret proclivities monitored by a so-called friend.
